Ugovor o radu

Prijavili ste se i dobili potvrdan odgovor. Vašoj karijeri u Njemačkoj više ništa ne stoji na putu. Vi samo morate još potpisati ugovor. Dat ćemo Vam nekoliko savjeta na šta biste trebali obratiti pažnju.

  • Dobro pročitajte ugovor

    Usmeni ugovori nisu uobičajeni u Njemačkoj. Ozbiljni poslodavci će Vam prema tome uvijek poslati pismeni ugovor. Dobro pročitajte ugovor prije nego što odlučite. Ako nešto ne razumijete, nije problem, pošaljite upit direktno nama ili nekom iz odjela za osoblje.

Šta bi trebalo pisati u Vašem ugovoru:

Vaš ugovor bi trebao sadržati sljedeće informacije:

  • Ime i adresa: Vaša adresa i adresa firme.
  • Početak ugovora: Od kojeg datuma ste radnik u firmi? Od kada je ugovor važeći?
  • Rok trajanja ugovora: Važi li vaš ugovor na određeno vrijeme? Kad ističe Vaš ugovor? Istek ugovora mora biti dogovoren u pismenom obliku, inače će ugovor o radu biti zaključen na određeno vrijeme.
  • Probni rad: Koliko dugo traje probni rad? To je vrijeme u kojem Vi i firma za relativno kratko vrijeme možete prekinuti ugovor.
  • Mjesto rada: Gdje ćete raditi? Ako biste trebali raditi na različitim mjestima onda to mora biti naznačeno u ugovoru.
  • Opis posla: Koji će biti vaši radni zadaci u firmi?
  • Plata: Koliko novca ćete dobiti za Vaš rad? Da li će Vam firma uz platu isplaćivati dodatne naknade ili premije, na primjer za Božić ili za rad vikendom? Kad će firma isplaćivati platu – na početku ili krajem mjeseca? Imajte u vidu: Po pravilu se ugovara bruto plata. Iz bruto plate se izdvajaju porezi i doprinosi za socijalno osiguranje, kao što su zdravstveno i penziono osiguranje i doprinosi za nezaposlenost.
  • Radno vrijeme: Koliko dugo morate raditi tokom sedmice? Godišnji odmor: Koliko dana godišnjeg odmora možete uzeti tokom godine?
  • Otkazni rok: Koliko dana unaprijed morate obavijestiti firmu da otkazom želite prekinuti radni odnos?
  • Kolektivni ugovori i sporazumi kompanije: Često pored ugovora o radu važe i druga posebna pravila. Udruženja poslodavaca i sindikati su, na primjer, sklopili kolektivni ugovor sa mnogim privrednim granama. Kolektivni ugovori mogu, na primjer, utvrditi platu, bonuse i pravo na odmor. Firme mogu i sa svojim sindikatom, kao predstavnikom radnika, sklopiti ugovor. Takvi ugovori se zovu sporazumi kompanije. Da li ovakva pravila važe za vas, to morate provjeriti kod poslodavca. To isto treba biti naznačeno u Vašem ugovoru o radu.
